1. Service Usage

  1. Registration Information: You are required to provide accurate and up-to-date registration information. If the information provided is false or incorrect, the Company reserves the right to refuse the provision of services.
  2. Account Security: You shall properly safeguard your account and password. You may not transfer, share, or lend your account to others.
  3. Device Permissions: Certain functions of this Service (e.g., QR code scanning, location services) may require device authorization. If you refuse or disable these permissions, the functionality of some services may be restricted.
  4. Acceptance of Terms: By using this Service, you agree to comply with these Terms of Service and all related announcements and regulations.
  5. Minors: If you are under the age of eighteen (18), your parent (legal representative or guardian) must read, understand, and agree to all contents of these Terms of Service before you may register as a member or use/continue to use this Service. When you register as a member or use any service provided by X MART, it shall be deemed that you have obtained such legal consent.
  6. Modifications: XMART reserves the right to add to or modify these Terms of Service. In the event of any additions or modifications, XMART will announce the changes on the website homepage or through other appropriate means. If you do not agree with the modified content, please discontinue the use of this Service immediately. If you continue to use this Service after the announcement, you will be deemed to have accepted and agreed to the revised terms.

2. Member Account and Rights

  1. Members may use features including login, participation in activities, point accumulation, redemption, and promotional notifications.
  2. The Member Barcode / QR Code is a unique identifier for the member. Do not provide it to others or use another person's identifier.
  3. If any account abnormality, theft, or violation is detected, the Company reserves the right to suspend or terminate related rights and benefits.

3. Usage Restrictions

You may not engage in the following behaviors:

    1. Impersonating others, misappropriating others' data, or forging an identity.
    2. Engaging in illegal activities, disrupting the Service, transmitting malicious programs, or interfering with the system.
    3. Capturing, reproducing, or using the content of this Service without authorization.
    4. Exploiting vulnerabilities, using plug-ins/external programs, or using illegal methods for profit or to improperly obtain points or offers.
    5. Improperly using location or scanning functions, including: misusing the Member QR Code, falsifying transactions, or abusing event activities.
    6. Engaging in any unauthorized marketing, advertising, sales, or other commercial activities.

4. Service Changes, Interruptions, and Liability Limitations

  1. The Company reserves the right to adjust, update, suspend, or terminate part or all of the Service.
  2. Service interruptions caused by system maintenance, force majeure (e.g., network outages, natural disasters), etc.; the Company is not liable for compensation.
  3. The Company is not liable for losses caused by the user's own equipment, network, or operational issues.

5. Intellectual Property Rights

All content within the Service (including interfaces, images, text, data, trademarks, etc.) belongs to the Company or its licensors. Unauthorized use, reproduction, distribution, or secondary creation is prohibited.

6. Termination of Service and Account Deactivation

  • If you violate these Terms or engage in improper conduct, the Company may suspend or terminate services without prior notice.
  • You may apply to deactivate your account at any time. After deactivation, some data will be preserved in accordance with laws and regulations.
  • Member Account Termination and Deletion: 
  1. Application Method:Members wishing to terminate the Service and delete their account must submit a request via the in-app contact mechanism or by sending an email directly to the Customer Service mailbox at [email protected] .
  2. Identity Verification and Documentation:To ensure account security and prevent malicious deletion by unauthorized third parties, Members are required to attach scanned copies of the following valid identification documents to their application for identity verification purposes:
    • Passport
    Resident Certificate (ARC)
    Note: The Company reserves the right to reject or suspend the processing of the deletion application if the Member fails to provide complete or legible copies of the aforementioned documents.
  3. Processing TimelineThe Company will review the application within 10 business daysupon receipt of the complete application documents. The processing result will be sent to the Member's registered email address.
  4. Irreversibility and Waiver of Rights:The Member acknowledges and agrees that account deletion isirreversibleand cannot be restored or recovered once completed. Upon deletion, the following legal consequences shall apply:
    • All personal data, transaction records, and order history will be archived or destroyed in accordance with the Privacy Policy.
    Any remaining membership benefits within the account (including but not limited to reward points, coupons, or membership tiers) shall be deemed voluntarily waived by the Member. The Company will not reissue, redeem for cash, or transfer such benefits.
  5. Disclaimer Members are advised to evaluate their decision prudently before submitting a deletion request. The Company assumes no liability for any data loss, loss of rights, or damages resulting from the account deletion, and shall not be liable for any compensation or indemnification.

7. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of China. In the event of any dispute arising from the Service, both parties shall negotiate in good faith. If the negotiation fails, the Taipei District Court in Taiwan shall be the court of first instance jurisdiction.
